How to avoid losing Sunshine Law rights.

It may seem odd that what you do can determine whether you have rights under the Sunshine Law or not.  In this week's tip of the week, you will see how a citizen did not take action he could have taken and as a result staff meetings at which his property was discussed were not subject to the Sunshine Law.  It's the case of the Reluctant Excavator.

Fictitious Names

The Tip of Next Week is on Fictitious Names and includes a link to the Fictitious Name law in the Florida Statutes.  Read the tip.

Venue

Venue is the Tip of the Week.  Every contract should have a clause on venue.   Go read your contracts or purchase orders, do you have a venue clause?  If you do business in more than one county, you need a venue clause.  Read the tip.

A new button has been added on the left side of the page, it's called "Legal Commentary."  Clicking this button will take you to a new page for my comments on legal topics.

The first subject on the new page describes an employment law seminar for business owners, managers, and HR Officers.  The seminar is presented by LORMAN Education Services.  The Seminar will help management with the constant problem of "How should I document the problems I am having with this problem employee?"

Although Florida is an employment-at-will state, there are numerous restrictions placed on management in the areas of employee discharge. While these laws do not prevent the discharge of the "problem employee" managers constantly face the dilemma of wondering if a discharge for the right reasons will subject the employer to a claim of discrimination. This seminar is designed to take you step-by-step through the legal and practical principles of employee discharge and documentation. You will learn what you should know, and more importantly, how to apply good discharge and documentation practices in an effective manner.
