What are the first four actions a supervisor should take upon learning of a situation involving The American's With Disabilities Act? What are the ten things a supervisor should never do? What is the "Fair, Anger, Right" test, and how do you apply it?

Most managers understand the elements of the ADA, and believe that their organization's written policy is a vaccine against ADA claims. Unfortunately, most managers don't discover the complexity of ADA compliance until they are engaged in a claim. In fact, your organization's written policy may be the claimant's "Exhibit 1."

True ADA compliance is tested more by the first four actions taken by a supervisor upon learning of an ADA situation than upon the organization's written policy.

Implementation of the ADA elements requires a situation-specific response. I can counsel you on how to gather information that will enable you to determine whether or not to provide a requested accommodation, and document facts and information that support your decision as the correct one.

Don't give your employees the ammunition they need to win a lawsuit against you. I offer seminars on ADA, EEOC and The Family and Medical Leave Act compliance. For more seminar information, please select the Seminars at Your Place of Business button.
